    Service of Process and Landlords

There are many civil actions filed in small claims court that deal with landlord and tenant issues.  Some of these claims take place in Downtown Los Angeles, Santa Monica, Glendale and surrounding cities.  A former tenant will will bring a civil action in small claims

Many of these court actions includes a landlord that fails to return a security deposit.  Most of these landlords know exactly what they are doing is wrong and they will attempt to avoid service at any cost.  A registered process server from motorcycle messenger will work hard on your side to get legal documents served on your former landlord.  You have to keep in mind that you cannot personally serve the papers yourself.

    Experience Serving Landlords

With our experience and know how, we get the job done where others have failed in the past.  We have had clients come to us after the Sheriff’s office was unable to serve a former landlord.  We keep our clients informed and notify them immediately upon service of process on their former landlords.

What some people do to avoid service of process

Service of Process in Small Claims Actions

There are those who take matters into their own hands and fight back by filing a small claims action with the court.  The next step is to give the opposing side, that would be the Defendant notice of the court hearing.  Some of the cases we provide service of process includes small claims actions where a  tenants has a security deposit dispute with previous landlord.  In one case, the landlord which will not be identified by her name to protect her privacy had placed security cameras all around the perimeter of her home.  Well, you would think that it would stop there, but it didn’t.  She had all her blinds shut, the gates locked, and all the doorbells were out of order.  If it was anyone one else, they would have given up and said she cannot be served, however, that is not how we do things at ECS – Motorcycle Messenger – Registered Process ServerThe Sheriff’s office had already gone out to serve her and was unsuccessful.  Service of process is a procedure that if done properly and according to the laws of the state will return a positive result.  There are dangers involved with attempting to serve people that are desperately refusing service of process and that is why it should be left to a professional to get the job completed for you.

To the right you will see a picture of a camera buzzer and below it the sign  reads: ” If you’re not expected — Don’t bother ringing.”  There is no way to out smart a registered process server.  This is an actual photo taken at a subject’s home who refused to be served and just one example of what people do to avoid service of process.

    Did you know ?

According to the Los Angeles Superior Court System, both the Plaintiff that is the party initiating the lawsuit and the Defendant must be properly designated on the claim.

Can a Lawyer represent me ?

Both parties in a case may consult with a lawyer, however, a lawyer may not represent you in a small claims action.  The exception is that after a judgment is handed down by the judge and if an appeal is filed, then both parties may be represented by a lawyer.

How does the defendant find out  I filed a lawsuit ?

The defendant must be notified about your lawsuit filed with the small claims court.  The process is known as service of process, which includes giving the defendant a copy of the claim.

Can I serve the defendant myself ?

YOU CANNOT serve the defendant yourself.  If you require assistance in service of process please contact our office to request a registered process server.  Our process servers are registered with the County of Los Angeles as well as insured.  We know the law of process serving and will do the job right.  An agent will serve your documents for a fee and complete a signed a proof of service indicating when the defendant was served.

Small Claims Court…Did you know ?

If you have a claim against someone in the amount of $5000.00 or less, chances are you will find yourself filing a claim at a small claims court in your jurisdiction.  The individual suing is the Plaintiff in the case and the opposing party is the Defendant.  Unlike civil court and trials, this process is inexpensive and simple.  A judge will hear both sides and make a decision on who wins the case and how the issues are settled.  Keep in mind that you may speak with a lawyer prior to your court hearing, however a lawyer may not represent you in court.  The exception is if you are appealing from a small claims matter.

    Notice must be given

Once you have filed your case with the small claims court, the court will issue you a court date.  You will have to notify the Defendant in your case of this date.  This process is required by law or else you will lose your case and it will not be heard.  You may hire a process server to handle it for you.  At Motorcycle Messenger- Registered Process Server, we serve small claims actions all the time.  It is better that you leave it upto the professionals, however you may also have someone other than the party involved serve the papers on your behalf.  The fact is we are registered with the County of Los Angeles, we are bonded and insured.  Sometimes the situation can get dangerous and that is why it is important to allow a professional process server handle it.

Can I settle my case ?

If both the Plaintiff and Defendant agree the case may be settled prior to trial.  However, both parties must notify the court as such.

    What happens if I don’t appear ?

If you do not appear for your court hearing, the judge in the case may issue the Plaintiff (party suing) what he or she is requesting plus court costs.  A judgment in the case will be issued to the Plaintiff.  In this circumstance the Plaintiff can legally garnish your wages, take your money, and property to satisfy the judgment.

    Dangerous Situation and Process Server

There are those that hate the process server “messenger” and for a reason.  A process server brings bad news to the doorsteps of those who are in some way wrapped up in a legal lawsuit.  Unfortunately, someone has to do the sometimes dangerous job of giving notice to the Defendant in the case.

In one case, I recall making several trips to a security company to have the over served in a civil matter.  As it is the case most of the time, the owners are nowhere to be found.  Luckily, an informant tipped me off with a home address where the subject may be found.  I made my way to subjects home where he refused to see me.

After several close confrontations with members of the household and workers, the subject came outside.  He was furious to say the least and was walking towards me with blood shot face.  I verified his identity and handed him his paperwork informing him he was being served.  This is where it was just about to turn for the worst.

Subject with his  tattooed up hoodlum for calling me every name in the book as if I was suing them.  Subject threatened to beat my face into the ground and was in my face telling me to “get the F*** out of here.”  “What the F**** are you doing coming to my house ? You are A**hole”

I knew if I didn’t act quickly something bad was going to happen.

Next time you think about serving papers yourself or having a friend do it for you, you may want to think twice.  Leave it up to the professional registered process serversto do the dangerous work.  We are registered and bonded with the County of Los Angeles and know how to handle some of the most difficult and dangerous situations imaginable.

The Birth of The Process Server (Part I)

It was back in 1999 and I was working for a Law Firm in Century City.  I got my start as a clerk and worked my way up to Investigator.  It wasn’t soon after that I was assigned the assignment of the lifetime by one of the partners at the firm.  They knew me well, hardworking, dedicated, and complete with integrity.

The assignment was to serve a practicing doctor at her home or office in Newport Beach, California. (If only I knew what I was getting myself into).  After several days of preparation and discussion with some of the associates at the firm, I decided to head out to her home before attempting to serve her at the office, if all else failed.  This would be a decision that I would live to never forget.

Motorcycle Messenger ECS employs registered process servers.  A registered process server is an individual that is licensed and bonded with the county in which they work.  They must be well educated in the laws relating to process of service.  As a registered process server some of the duties include serving summons, complaints, notices and other relevant legal documents as required by the court system.  It is not as easy as it may seem, there are lots of rules and regulations that must be abided by as there are lots of complications that arise with each case.

In many cases, the Defendant (party being sued) does not want to be served with legal documents or is not available at the address on record.  This is where a professional registered process server differs from a normal individual and the agent’s experience will be implemented in obtaining the necessary information from legal sources.  Yes, it is not an easy task, but we know what we are doing and we always get our “man”.   At Motorcycle Messenger – Registered Process Server (ECS) we handle some of the most difficult process of server and sometimes not so difficult.  No matter what the circumstance asks for, we handle it in a professional and competent matter according to the governing laws of the State of California.
