How to hire a Process Server

Hiring a professional process server may seem like an easy task at hand, however with all the horror stories consumers need to be educated on how to select the right process server for the job.  There are definitely a lot of companies that promote process service some are reliable and some are not.  You definitely don’t want to be stuck with a process server that cannot deliver on his or her promise because it may eventually determine the outcome of your legal case.

What to look for in a Process Server

Some companies will promise anything to get your business.  Some will advertise low rates to draw you in and hit you with hidden fees or possibly not serve your legal documents.  Unfortunately there are many incompetent process servers out there that just don’t care.  There is an old saying that most people should know by now ‘you get what you pay for’.  The general public should become educated on what key areas to look for when hiring a process server.  Remember the outcome of your case may be determined on how the process server completes his or her duties.  Motorcycle Messenger is a courier service and registered process service company based in Los Angeles.  With a reputation for getting the job completed in a professional manner including serving documents that may have previously been attempted unsuccessfully.  The first thing the consumer should know is whether or not the company employs registered process servers.  A Registered Process Server is an individual that is educated and experienced in the local laws pertaining to service of legal documents.  Some legal service may include small claims, subpoena, divorce, levy, writ of execution, 3 day notice, summons and much more.  California law requires any process server that serves 10 or more documents per year to be registered and bonded.

Ask questions, ensure that the process server you are hiring is registered and bonded in the county in which they are performing service of process.

    Process Server and Communication

It is very critical that the client provide the process server with as much information as possible pertaining to the person(s) being served.  This will not only help you with a better outcome, it will also aid the process server in the field to make the correct identification.  Communication is the key when it comes to working with a professional process server and keep in mind this communication will go both ways.  If you have photos of the subject, vehicle description(s) anything pertinent to assisting the process server provide it.  There is no such thing as too much information.  Also, don’t wait until it is too late.  The process server you hire may require more time to serve the legal documents than you may have originally thought.

    Process Server Court Testimony

What sets us apart from your typical server is that we are registered, bonded and experienced.   However, it doesn’t stop here.  A registered process server has a great deal of responsibility and we take this responsibility very seriously. When we sign our proof of service, we are declaring under the penalty of perjury under the laws of the state we practice that all the information provided is true and correct.  Recently, a registered process server on our team was requested to testify in court.

    We Support Our Clients

We were called by our client to testify in court with respect to the service of process we had completed.  We support our clients every step of the way.   It is our obligation and duty to respond generously and report to court to support our client.  The case stems from a defendant that was evading service on several occasions.  The Sheriff’s office had attempted to serve her and was unsuccessful.

    Court Date

With the proper documentation in hand and as a result of our dilligent work; we properly served the legal documents in accordance with the laws of the State of California.  The Judge assigned to the case reviewed the proof of service we had submitted along with all evidentiary documentation.  The Judge ruled in favor of our client and was pleased to see the registered process server that served the legal documents in court testifying in person.

What some people do to avoid service of process

Service of Process in Small Claims Actions

There are those who take matters into their own hands and fight back by filing a small claims action with the court.  The next step is to give the opposing side, that would be the Defendant notice of the court hearing.  Some of the cases we provide service of process includes small claims actions where a  tenants has a security deposit dispute with previous landlord.  In one case, the landlord which will not be identified by her name to protect her privacy had placed security cameras all around the perimeter of her home.  Well, you would think that it would stop there, but it didn’t.  She had all her blinds shut, the gates locked, and all the doorbells were out of order.  If it was anyone one else, they would have given up and said she cannot be served, however, that is not how we do things at ECS – Motorcycle Messenger – Registered Process ServerThe Sheriff’s office had already gone out to serve her and was unsuccessful.  Service of process is a procedure that if done properly and according to the laws of the state will return a positive result.  There are dangers involved with attempting to serve people that are desperately refusing service of process and that is why it should be left to a professional to get the job completed for you.

To the right you will see a picture of a camera buzzer and below it the sign  reads: ” If you’re not expected — Don’t bother ringing.”  There is no way to out smart a registered process server.  This is an actual photo taken at a subject’s home who refused to be served and just one example of what people do to avoid service of process.

Small Claims Court…Did you know ?

If you have a claim against someone in the amount of $5000.00 or less, chances are you will find yourself filing a claim at a small claims court in your jurisdiction.  The individual suing is the Plaintiff in the case and the opposing party is the Defendant.  Unlike civil court and trials, this process is inexpensive and simple.  A judge will hear both sides and make a decision on who wins the case and how the issues are settled.  Keep in mind that you may speak with a lawyer prior to your court hearing, however a lawyer may not represent you in court.  The exception is if you are appealing from a small claims matter.

    Notice must be given

Once you have filed your case with the small claims court, the court will issue you a court date.  You will have to notify the Defendant in your case of this date.  This process is required by law or else you will lose your case and it will not be heard.  You may hire a process server to handle it for you.  At Motorcycle Messenger- Registered Process Server, we serve small claims actions all the time.  It is better that you leave it upto the professionals, however you may also have someone other than the party involved serve the papers on your behalf.  The fact is we are registered with the County of Los Angeles, we are bonded and insured.  Sometimes the situation can get dangerous and that is why it is important to allow a professional process server handle it.

Can I settle my case ?

If both the Plaintiff and Defendant agree the case may be settled prior to trial.  However, both parties must notify the court as such.

    What happens if I don’t appear ?

If you do not appear for your court hearing, the judge in the case may issue the Plaintiff (party suing) what he or she is requesting plus court costs.  A judgment in the case will be issued to the Plaintiff.  In this circumstance the Plaintiff can legally garnish your wages, take your money, and property to satisfy the judgment.

    Dangerous Situation and Process Server

There are those that hate the process server “messenger” and for a reason.  A process server brings bad news to the doorsteps of those who are in some way wrapped up in a legal lawsuit.  Unfortunately, someone has to do the sometimes dangerous job of giving notice to the Defendant in the case.

In one case, I recall making several trips to a security company to have the over served in a civil matter.  As it is the case most of the time, the owners are nowhere to be found.  Luckily, an informant tipped me off with a home address where the subject may be found.  I made my way to subjects home where he refused to see me.

After several close confrontations with members of the household and workers, the subject came outside.  He was furious to say the least and was walking towards me with blood shot face.  I verified his identity and handed him his paperwork informing him he was being served.  This is where it was just about to turn for the worst.

Subject with his  tattooed up hoodlum for calling me every name in the book as if I was suing them.  Subject threatened to beat my face into the ground and was in my face telling me to “get the F*** out of here.”  “What the F**** are you doing coming to my house ? You are A**hole”

I knew if I didn’t act quickly something bad was going to happen.

Next time you think about serving papers yourself or having a friend do it for you, you may want to think twice.  Leave it up to the professional registered process serversto do the dangerous work.  We are registered and bonded with the County of Los Angeles and know how to handle some of the most difficult and dangerous situations imaginable.
