Small Claims Process Servers serve legal documents ordered by small claims court. The action begins when a plaintiff, the party brining forth the lawsuit files a claim under $7500 with small claims court. The plaintiff then has the option of serving their legal documents by the Sheriff’s Department Civil Division or a Registered Process Server. There is a huge difference between the two and that is a registered process server will work 7 days a week, early days and nights and go above and beyond for their clients. This is not true for all registered process servers, only the professional and well established ones.
Process servers often get a bad rap simply because they are doing their job of delivering legal documents. Most defendants will attempt to avoid service of process at any cost. However, what they don’t realize is they will get served sooner or later. The frustration and anxiety these defendants will endure to avoid a process server is not worth it at the end of the day. Process servers have a very difficult and dangerous job; they are told stories not true as to the whereabouts of the subject being served with legal documents. Whether it is a small claims action, divorce or a restraining order, the situation is always the same. People will avoid the process server. There have been situations where a subject has gotten in the car and fled from the scene and a chase had ensued. Some decide to barricade themselves within their residence, not matter how these subjects select to hide from the process server at the end of the day they will get served.
